MINUTES OF PROCEEDINGS

Meeting of the Parliament

Wednesday 5 July 2000


Note: (DT) signifies a decision taken at Decision Time.

The meeting opened at 9.30 am.


1. Time for Reflection: The Rev Dr Findlay A J Macdonald, Principal Clerk to the General Assembly of the Church of Scotland, led Time for Reflection.

2. Business Motion: Mr Tom McCabe, on behalf of the Parliamentary Bureau, moved S1M-1084-That the Parliament agrees as an addition to the Business Motion agreed on 29 June 2000-

Thursday 6 July 2000

after 'Executive Debate on Modernisation in the NHS', insert-

followed by Debate on Motion on Government Resources and Accounts Bill - UK Legislation

and after 'Continuation of Executive Debate on Modernisation in the NHS', insert-

followed by Standards Committee Motion on Relationships with MSPs

followed by Motion on Political Parties, Elections and Referendums Bill - UK Legislation

and delete-

'Motion on Government Resources and Accounts Bill - UK Legislation'

The motion was agreed to.

3. Meeting of the Parliament: Mr Tom McCabe, on behalf of the Parliamentary Bureau, moved S1M-1089-That the Parliament agrees under the Rule 2.2.7 that the meeting of Parliament on Wednesday 5 July 2000 shall continue to 1900.

The motion was agreed to.

4. Decision Time: Mr Tom McCabe, on behalf of the Parliamentary Bureau, moved S1M-1090-That the Parliament agrees under Rule 11.2.4 that Decision Time on Wednesday 5 July 2000 shall begin at 1830.

The motion was agreed to.

5. Business Motion: Mr Tom McCabe, on behalf of the Parliamentary Bureau, moved S1M-1092-That the Parliament agrees that for Stage 3 of the Bail, Judicial Appointments etc. (Scotland) Bill and the National Parks (Scotland) Bill, debate on each part of the proceedings, if not previously brought to a conclusion, shall be brought to a conclusion at the following times (calculated from the time when Stage 3 of the Bail, Judicial Appointments etc. (Scotland) Bill begins)-

Bail, Judicial Appointments etc. (Scotland) Bill

Group 1 to Group 4 - no later than 1 hour 15 minutes

Group 5 - no later than 1 hour 45 minutes

Group 6 to Group 10 - no later than 3 hours

Motion to pass the Bill - no later than 3 hours 30 minutes

National Parks (Scotland) Bill

Group 1 to Group 4 - no later than 4 hours 30 minutes

Group 5 - no later than 5 hours 15 minutes

Group 6 to Group 7 - no later than 6 hours

Group 8 to Group 11 - no later than 7 hours

Motion to pass the bill - no later than 7 hours 30 minutes.

The motion was agreed to (by division: For 63, Against 28, Abstentions 14).

6. Bail, Judicial Appointments etc. (Scotland) Bill: The Bill was considered at Stage 3.

The following amendments were agreed to (without division): 1, 2, 3, 4, 5, 6.

The following amendments were disagreed to (by division)-

13 (For 16, Against 90, Abstentions 0)

19 (For 42, Against 65, Abstentions 0)

25 (For 16, Against 93, Abstentions 0)

The following amendments were moved and, with the agreement of the Parliament, withdrawn: 14, 16, 17, 27 and 28.

Other amendments were not moved.

7. Bail, Judicial Appointments etc. (Scotland) Bill: The Deputy First Minister and Minister for Justice moved S1M-1079-That the Parliament agrees that the Bail, Judicial Appointments etc. (Scotland) Bill be passed.

The motion was agreed to (DT).

8. National Parks (Scotland) Bill: The Bill was considered at Stage 3.

The following amendments were agreed to (without division): 1, 2, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 30, 19, 33, 37, 40, 41, 42, 43, 45, 48, 53, 55, 59, 61, 62, 64, 66, 67, 68, 69 and 70.


The following amendment was agreed to (by division)-

3 (For 98, Against 3, Abstentions 0)

The following amendments were disagreed to (by division)-

28 (For 38, Against 63, Abstentions 1)

18 (For 17, Against 90, Abstentions 1)

26 (For 31, Against 80, Abstentions 2)

27 (For 18, Against 84, Abstentions 0)

The following amendments were moved and, with the agreement of the Parliament, withdrawn: 21, 31 and 35.

Other amendments were not moved.

9. National Parks (Scotland) Bill: The Minister for Transport and the Environment moved S1M-957-That the Parliament agrees that the National Parks (Scotland) Bill be passed.

The motion was agreed to (DT).

10. Motion without notice: Mr Tom McCabe, on behalf of the Parliamentary Bureau, moved under Rule 11.2.4, that Decision Time be taken at 5.27 pm.

The motion was agreed to.

11. Decision Time: The Parliament took decisions on items 7 and 9 as noted above.

12. West Kilbride: Scotland's Craft Town: The Parliament debated S1M-756 in the name of Allan Wilson-That the Parliament welcomes the consultant's report confirming the feasibility of establishing West Kilbride as Scotland's Craft Town; congratulates Councillor Elizabeth Maclardy and the West Kilbride Initiative on the vision and persistence with which they have pursued this objective; recognises the economic and social impact which the initiative can secure for West Kilbride; believes that it can provide a new and important focal point for the Scottish crafts industry as a whole, and looks forward to rapid progress towards a successful outcome.

The meeting closed at 5.52 pm.
